Terms of Service

By requesting or using services, you agree to these Terms and any applicable proposal, service agreement, or written order. You must have authority to act for the business identified in the order. The services are intended for businesses and authorized adult users.

Services may include a 100% custom website, CRM and lead management, customer and project management, booking, customer portal, Built-In Accounting Software, documents, communications, automation, business settings, branding controls, SEO and marketing foundations, knowledgebase tools, and hosting or support, depending on the selected service model and configuration.

AI-assisted functionality, SMS/MMS, marketing email, payment integrations, and other capabilities are available only when separately enabled and configured.

• Standard builds are approximately 5–7 days after required information, content, assets, and requirements are ready; this is not a guaranteed completion date.
• Two reasonable in-scope revision rounds are included. PSD-caused defects do not consume a revision round. Additional Revision Round pricing is $150 one-time.
• The standard allowance is up to 7 primary navigation pages plus up to 10 additional pages, for 17 included pages. Pages 18–27 may be added through the $500 one-time Additional Custom Pages option. Larger sites up to 100 pages are priced by consultation.
• 72-Hour Express Build is $500 one-time. 48-Hour and 24-Hour Express Builds are priced by consultation. Eligibility and timing depend on confirmed scope and readiness.
• Customer delays, missing materials, scope changes, unusual complexity, third-party dependencies, or circumstances outside reasonable control may affect timing.
• Customer approval is required before public launch.

Managed service places more responsibility for hosting, infrastructure, maintenance, security, updates, and the technical environment with PLATFORM STUDIO DESIGNS. Owner Self-Managed provides the same core professional foundation with greater customer responsibility, control, and applicable ownership/transfer rights.

PLATFORM STUDIO DESIGNS LLC d/b/a PLATFORM STUDIO DESIGNS provides the custom website, connected platform, and customer service relationship. Certain hosting and domain-reseller services may be provided or administered by PSD Domain Hosting & Solutions LLC d/b/a PSD Domain Hosting & Solutions.

Hosting, SSL, domain management while subscribed, maintenance, and phone support are provided according to the applicable service arrangement. Domains are obtained through an underlying registrar, currently NameSilo where applicable; PSD Domain Hosting & Solutions LLC is a reseller or service intermediary, not the registrar, sponsoring registrar, or an ICANN-accredited registrar.

Availability, renewals, transfers, registration status, disputes, and other domain actions remain subject to registrar, registry, and applicable ICANN or provider rules. Customer registration information must be accurate where required. Domains, email, DNS, carriers, payment providers, external APIs, and other third parties may experience outages, filtering, delays, or restrictions. Uninterrupted operation and message delivery cannot be guaranteed.

You retain rights in your business name, trademarks, logos, images, content, business/customer data, records, documents, financial records, and other materials you supply. You represent that you have the rights and permissions needed for their use.

You are responsible for lawful collection, notices, consent, accuracy, customer communications, uploaded content, and compliance with applicable email, phone, SMS, MMS, privacy, and intellectual-property laws.

PLATFORM STUDIO DESIGNS retains its reusable platform technology, architecture, frameworks, modules, shared libraries, automation systems, internal tools, infrastructure methods, and development methods. Managed service does not automatically transfer reusable PSD source or infrastructure.

After applicable build and account obligations are paid, Owner Self-Managed transfer rights may include customer-specific implementation/configuration, data, files, assets, domain control where applicable, separable customer-specific code, and reasonable documentation. Domain procurement or management through a reseller does not change these platform intellectual-property terms; transfer timing remains subject to account obligations, registrar or registry rules, applicable waiting periods, and third-party requirements. Core reusable PSD intellectual property remains PSD property. No separate PSD transfer fee is charged, but third-party and migration costs may apply.

Service fees and payment schedules are established in the applicable proposal or agreement. Optional in-house financing uses a $150 fixed finance charge, with $75 down and the remaining $75 added to the final build payment over 10–36 months. It is a payment structure, not a feature or add-on.

Project cancellation requires written notice. Amounts earned for completed work, the initial/down payment once work begins, and committed third-party costs remain due or non-refundable as described in the Refunds & Cancellation Policy. Hosting/service is month-to-month unless a signed agreement states otherwise; cancellation notice should be provided before the next renewal.

Failure to pay required earned amounts may result in suspension after notice. Additional remedies are governed by the applicable signed agreement and law. No late fee, penalty interest, collection charge, credit reporting, or acceleration term is created by these Terms.

The Acceptable Use Policy and Messaging Terms are incorporated when applicable. Customers may not use the platform for unlawful activity, spam, phishing, malware, harassment, deceptive communications, unauthorized access, infringement, suppression evasion, carrier abuse, or prohibited high-risk campaigns.

Services may change as technology and third-party dependencies change. Except as expressly stated in a signed agreement, services are provided on a reasonable-efforts basis and specific outcomes are not guaranteed.

These Terms do not create mandatory arbitration, a jury waiver, class-action waiver, damages cap, indemnity scope, or detailed venue provision. Those matters require attorney-reviewed language in a signed agreement if they are to apply. Florida law may govern where stated in the applicable agreement.
